Amendment to Final Version of Agency Workers Regulations
The Final Version of The Agency Workers Regulations (AWR) has been issued and contained a number of welcome changes.
One change was a drafting error that meant if there was no break in assignments then the Swedish Derogation model would not be successful in avoiding the need for comparable pay.
The final change however went a step further saying that pay between assignments only had to be paid if the was a gap after the first assignment. This means that the chances of there having to be a payment between assignments is greatly reduced.
It also means that a recruitment agency offering a second assignment to an employee already employed under Swedish Derogation has no AWR concerns.
